Terms of Service

These Terms of Service set out the rules for using the website available at j1-os.pl (the “Service”), including the rules for using the contact form available within the Service.

1. Definitions

Terms used in these Terms of Service have the following meaning:

  • Service Provider / Controller — Filip Stasiński, a sole proprietor registered in Poland, NIP: 558-187-48-60, email: filip.stasinski@j1-os.pl;
  • Service — the website available at j1-os.pl, including its subpages;
  • User — any person using the Service;
  • Contact form — the electronic form available within the Service that allows a message to be sent to the Service Provider;
  • App — the J1-OS system available at app.j1-os.pl, to which the information presented in the Service relates; use of the App is governed by a separate set of terms made available within the App.

2. Nature and scope of the Service

The Service is informational and promotional in nature. Its purpose is to present the App and to allow Users to contact the Service Provider, including in order to obtain access to the App.

The Service does not allow you to enter into sales agreements, make payments, or register an App account — these actions take place directly within the App at app.j1-os.pl and are governed by its own terms of service and privacy policy.

3. Technical requirements

Using the Service requires: a device with Internet access, a current web browser supporting HTML5, CSS3 and JavaScript and accepting cookies, and, to use the contact form, an active email address. The Service Provider does not guarantee full compatibility of the Service with every hardware and software configuration.

4. Services provided electronically

Through the Service, the Service Provider provides the following services electronically, within the meaning of the Polish Act on Providing Services by Electronic Means:

  • making informational content about the App available;
  • making the contact form available, allowing a message to be sent to the Service Provider.

Use of the above services is free of charge and voluntary.

5. Rules for using the contact form

By sending a message via the contact form, the User undertakes to provide true and current information and not to include in the message any unlawful, offensive content, content that infringes the rights of third parties, or content otherwise contrary to law or good practice.

  • the “email address” and “message” fields are mandatory; the “first name”, “last name” and “phone” fields are optional;
  • submitting the contact form does not constitute entering into an agreement for access to the App — it is merely an expression of interest or an inquiry, to which the Service Provider will respond within a reasonable time;
  • the Service Provider does not guarantee any specific response time to messages sent via the contact form.

The rules for processing personal data submitted via the contact form are described in the Privacy Policy.

6. Intellectual property

All rights to the content published within the Service, including text, graphics, trademarks, logos, layout elements and source code, belong to the Service Provider or to entities with which the Service Provider has entered into appropriate licensing agreements, and are protected under applicable law, in particular the Polish Act on Copyright and Related Rights and the Polish Industrial Property Law. Copying, reproducing, modifying or using the content of the Service for commercial purposes without the Service Provider's prior written consent is prohibited, except for personal, non-commercial use permitted by law.

7. Liability

The content presented in the Service is informational in nature and does not constitute an offer within the meaning of the Polish Civil Code. The Service Provider makes reasonable efforts to keep the information in the Service accurate and up to date, but reserves the right to change it as the App evolves, without prior notice.

  • the Service Provider is not liable for interruptions in the availability of the Service resulting from technical reasons, force majeure, third-party actions, or necessary maintenance work;
  • the Service Provider is not liable for damages resulting from the use of, or inability to use, the Service, except in cases of intentional misconduct, to the extent permitted by applicable law;
  • the Service Provider is not liable for the content of third-party websites that may be linked to from within the Service.

8. Protection of personal data

The rules for processing Users' personal data, including the purposes, legal bases, retention periods and security measures, are described in detail in the Privacy Policy, available at j1-os.pl/en/privacy (and j1-os.pl/privacy in the Polish version), which forms an integral supplement to these Terms.

9. Security of the Service

The Service Provider takes technical measures to ensure the security of using the Service, in particular:

  • encrypting the connection to the Service via HTTPS/TLS;
  • protecting data submitted via the contact form against unauthorized access by third parties, including through database access-control mechanisms (Row Level Security);
  • validating and filtering data submitted through the contact form to reduce the risk of malformed or malicious submissions.

Users must use the Service in a manner that does not disrupt its operation, in particular by refraining from actions that could disrupt the Service, such as introducing malicious software, attempting unauthorized access to the Service Provider's IT systems, or placing an excessive load on the Service's infrastructure.

10. Complaints procedure

Users may file a complaint regarding the operation of the Service or the services provided through it. Complaints should be sent to: filip.stasinski@j1-os.pl, describing the issue and providing contact details for a reply.

The Service Provider will review the complaint without undue delay, and no later than 14 days from receipt, and will inform the User of the outcome at the email address from which the complaint was sent.

11. Out-of-court dispute resolution

A User who is a consumer may use out-of-court methods of handling complaints and pursuing claims, including assistance from the locally competent Provincial Trade Inspectorate and permanent consumer arbitration courts. Consumers may also use the EU Online Dispute Resolution (ODR) platform, available at: ec.europa.eu/consumers/odr.

12. Changes to these Terms

The Service Provider reserves the right to amend these Terms for valid reasons, in particular changes in law, changes to the scope or manner of providing services within the Service, security considerations, or a change in the Service Provider's details. Amended Terms take effect on the date they are published within the Service, together with an indication of the date of the last update.

13. Final provisions

Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means, and the GDPR.

  • These Terms are governed by Polish law.
  • Any disputes arising in connection with the use of the Service will first be resolved through negotiation, and failing agreement, by the court having jurisdiction under applicable law.
  • If any provision of these Terms is found to be invalid or unenforceable, this will not affect the validity of the remaining provisions.
